Welcome to TelehealthHires, a remote health job portal. These Terms of Service (“Terms”) govern your access to and use of the services provided by the website administration (referred to herein as “we,” “us,” or “our”) through our job portal website (the “Service”). By accessing or using the Service, you agree to be bound by these Terms and all applicable laws and regulations.

1. Acceptance of Terms

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. If you disagree with any part of the terms, then you may not access the Service.

2. Use of the Service

The Service acts as a platform connecting healthcare professionals seeking remote employment (“Job Seekers”) with employers or recruiters posting job opportunities (“Employers”).

2.1 Eligibility

By using the Service, you affirm that you are at least 18 years of age or have reached the age of majority in your jurisdiction, whichever is greater, and have the legal capacity to enter into these Terms.

2.2 Job Seeker Obligations

  • Job Seekers agree to provide accurate, current, and complete information in their profiles and applications.
  • Job Seekers are solely responsible for the content and accuracy of the information they submit.
  • Job Seekers must adhere to all applicable licensing, certification, and regulatory requirements for the health professions they represent. The website administration does not verify the validity of licenses or certifications.
  • Job Seekers agree not to use the Service for any unlawful purpose or in any way that is prohibited by these Terms.

2.3 Employer Obligations

  • Employers must ensure that all job postings accurately reflect the requirements, compensation, and location (remote status) of the position.
  • Employers warrant that they have the legal right and authority to post the jobs and conduct hiring activities advertised.
  • Employers must comply with all applicable local, state, federal, and international employment laws, including non-discrimination laws.
  • Employers must promptly remove job postings once the position has been filled or the application window has closed.

3. User Conduct and Prohibited Activities

You agree not to use the Service to:

  • Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Impersonate any person or entity, including any employee or representative of the website administration.
  • Post or transmit any unsolicited advertising, promotional materials, “spam,” or chain letters.
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
  • Attempt to gain unauthorized access to any portion of the Service, related systems, or networks.
  • Transmit any material that contains viruses, Trojan horses, worms, time bombs, corrupted files, or any other similar software or programs that may damage the operation of another’s computer or property.

4. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of the website administration and its licensors. The Service is protected by copyright, trademark, and other laws of both the jurisdiction where the website administration is based and foreign countries. You are solely responsible for the User Content you post. We reserve the right, but not the obligation, to remove any User Content we deem in violation of these Terms or our policies.

Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE WEBSITE ADMINISTRATION EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

The website administration makes no warranty that (i) the Service will meet your requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate or reliable, or (iv) the quality of any products, services, information, or other material purchased or obtained through the Service will meet your expectations.

We are a platform provider and are not an employer, recruiter, or employment agency. We do not guarantee employment, the completion of any transaction, or the truthfulness or completeness of any information provided by Users. All hiring decisions, salary negotiations, and compliance with employment law are solely the responsibility of the Employer and Job Seeker.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE WEBSITE ADMINISTRATION, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

IN NO EVENT SHALL THE WEBSITE ADMINISTRATION’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT, IF ANY, PAID BY YOU TO THE WEBSITE ADMINISTRATION FOR ACCESSING THE SERVICE IN THE THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

9. Indemnification

You agree to defend, indemnify, and hold harmless the website administration and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of (i) your use and access of the Service, by you or any person using your account and password; (ii) a breach of these Terms, or (iii) any User Content posted on the Service.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the website administration primarily operates, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will attempt to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
